A Law Not Yet Honored
Congress renamed the Hinesville clinic for four fallen heroes. The building's primary signage still bears a name Congress never authorized for it.

In Brief
What Happened
On May 13, 2024, Public Law 118-61 became federal law, directing that the Department of Veterans Affairs clinic in Hinesville, Georgia, “shall…be known and designated” as the John Gibson, Dan James, William Sapp, and Frankie Smiley VA Clinic — honoring four Liberty County men killed in action in Vietnam in 1968.
More than two years later, the clinic’s primary exterior identification still reads “Ralph H. Johnson Healthcare System” — a name Congress never authorized for this facility — while the four heroes’ mandated name is relegated to a secondary monument sign. Plaintiffs have exhausted the VA’s administrative channels and now seek judicial review under the Administrative Procedure Act and a writ of mandamus to compel full compliance.
The Key Issues
Why It Matters in Law
- A mandatory duty. Public Law 118-61 uses the word “shall” — a non-discretionary command that the clinic be designated by the four heroes’ names.
- The wrong law was applied. Public Law 101-488 (1990) named only the Charleston, South Carolina VA Medical Center “Ralph H. Johnson” — it does not extend to clinics in other cities, counties, or states.
- Geographic-naming rule. 38 U.S.C. § 531 limits VA facility naming to the geographic area absent express statutory authority.
- No variance was submitted. By the VA’s own FOIA response, no signage variance was submitted to the Center for Facilities Management as the VA’s mandatory design manual requires.
- The VA seal appears on the signage, contrary to the VA’s own PG 18-10 Design Manual.
- One of a kind. Of roughly 1,294 VA facilities nationwide, this is the only one whose primary exterior signage does not reflect its Congressionally or statutorily designated name.
- Remedies exhausted. Administrative complaints, FOIA appeals, and oversight referrals were pursued; the VA’s regional network issued a “final response” finding no wrongdoing.
